VILLAGE OF LIVINGSTON
REGULAR BOARD MEETING
TUESDAY, SEPTEMBER 7, 2010
Meeting called to order at 7:10 PM.
Clerk Johnson took roll call Tom Brown Yes, Ron Haas Yes, Rosie Gluege Yes, Kyle Richards Absent, Deb France Yes, Tim Loeffelholz Yes and Randy Warne Yes. Also present were Clerk Johnson, Betty Shambow and Joe Kitelinger.
Clerk Johnson verified the agenda was posted at the Village Post Office, Village Message Board and Village Office on 9/2/10.
Bart from Delta 3 said that he has received 3 pay request and 1 change order. Ron made a motion to approve the pay request from from Municipal Well & Pump in the amount of $28747.00. Tim second the motion. All I. Motion carried. Rosie made a motion to approve the pay request from from Iowa-Grant Trucking in the amount of $22829.26 Deb seconded the motion. All I. Motion carried. Ron made a motion to approve the pay request from Gehrmann Construction in the amount of $22895.00 and the change order in the amount of $1950.00. Deb seconded the motion. All I. Motion carried. All of these bills are for the Well 2. Bart also said that things are going good. Tim made a motion to approve the bills to be paid Delta 3 in the amount of $3696.00 and $592.00 for the Well 2 project.
Tim made a motion to approve the August 2, 10 minutes. Deb seconded the motion. All I. Motion carried.
Deb made a motion to approve the August Treasurer Reports. Randy seconded the motion. Tom Brown Yes, Ron HaasYes, Rosie Gluege Yes, Kyle Richards Absent, Deb France Yes, Tim Loeffelholz Yes and Randy Warne Yes. Motion carried.
Lois presented the board and the residents with having a dog park within the Village. Lois stated that they would like to have the dog park at the Ball Park. There are about 7 people that would be willing to donate $100.00 each to go towards the park and that they would hold fund raisers and take donations from other people around to keep the park going. Lois would like this park to be open to other communities. The dog owner would be liable for their own dogs’ behavior and to pick up behind their dog. Several residents do not want the park at the Ball Park due to the destruction of the grass and that kids play there and also that the village would have to maintain the park. Some residents do not want their tax dollars going to pay for this dog park so a resident suggested that the dog license be increased to help pay for it. Tim made a motion to table this issue until the next board meeting in order to contact village attorney. Ron seconded the motion. All I. Motion carried.
Ric Riniker
Ric was not present but he typed up a report that is available at the village office.
Police Report
Steve has giving out several tickets. There has been several thefts with in the village so make sure you keep your cars and doors locked and just keep a watchful eye open.
Clerks Report
Tim made a motion to approve Rachel Graber for an Operator License. Ron seconded the motion. All I. Motion carried. Deb made a motion to approve and signing the Matching Fund checking account. Randy seconded the motion. All I. Motion carried. The board discussed Eldon Warne building permit and he is going to have to attend the planning and zoning meeting. Dawn gave every board member a copy of the budget for 11 and she instructed them that the budget needs to be filled in and approved by the December meeting. Dawn received new ordnances in the mail regarding Land Division; the ordnance will be forward on to the attorney for his review.
Library Report
The library has received 2 new computers from the grant with 2 more to come next year. She would like to thank the board for all the support that they have giving the library. Fall toddler time starts in September 22. There have been a few more problems with the toilets getting clogged. Library use is up 66% sense this time last year.
Citizens Concerns
Complaints about the old laundry mat. Dawn is going to call Todd Infield and ask him to send out a letter to the owners regarding that it needs to be taking down. Also there have been complaints about cigarette butt being left in the street. Dawn will send all bar owners a letter asking them if they could sweep up the butt so the streets look nice.

Ron made a motion to approve Dawn to take money out of the LGIP Savings Account at Livingston State Bank. Deb seconded the motion. All I. Motion carried.
Maintenance Report
Joe said that there are major problems with the painting of the old well. There are several things wrong with it , the lettering is wrong, when they welded the door on they got cast off of hot metal on the tower which has begun to rust, panel inside was broken and the paint is starting to bubble. The main guys from the company are suppose to come next week and take a look at the tower . Joe will let us know what happen at next meeting. Also Tim made a motion to continue with the construction of the shelter at Ball Park with
a cap of $35000.00. Ron seconded the motion. All I. Motion carried. There is going to be parts of Livingston that will be without power on Thursday the 9. The Tree Committee has given Joe a list of trees that need to be removed. Joe will take a look and see if any on the list have all ready been removed.
Tim made a motion to go into closed session at 9:10 pm. Rosie seconded the motion. All I. Motion carried.
Ron made a motion to come out of closed session at 9:35 pm. Deb seconded the motion. All I. Motion carried.
Tim made a motion to adjourn at 9:35 pm. Rosie seconded the motion. All I. Motion carried.
