VILLAGE OF LIVINGSTON
REGULAR BOARD MEETING
TUESDAY – JUNE 12, 2012
President Brown called meeting to order at 7:00 PM.
Those in attendance: Brown- Yes, Gluege-Yes, Walter - Yes, France -Yes, Loeffelholz –Yes. Arriving at 7:02pm were Haasand Richards. Also present were RicRiniker, Gary Stuckey, Christina Christianson, John Scullion, and Pastor GregMarsh.
Clerk Christianson verified the agenda was posted at theVillage Post Office, Village Message Board and Village Office on 6/07/12. Boardmember packets were delivered to all members on 6/07/2012.
Motion made by Loeffelholz to approve May Minutes with thefollowing corrections: to Library report, summer hours will start, instead ofsupper hours will state. Also under Old Business, taking out the word him,which was speaking in the area of the shelter. France seconded. All infavor. Motion carried.
Clerk Report
Christina asked for approval of attending the clerkconvention in Middleton on August 22, 23, and 24th. The possibility of staying overnight is notyet determined as she is unsure of starting time Wednesday morning for the newclerk class and will possibly stay one or two nights (Tue and/or Wed). Motionmade by Loeffelholz to approve clerk Christianson to attend conference. France seconded. All in favor. Motion carried. Clerk informedthe board that over forty 10 day notices have been mailed out for past duewater bills. President Brown commentedon the possibility of recording incoming calls in the future. This is a tool some people use for trainingpurposes. It was discussed and agreedupon that the meeting date and time will stay the same for Village BoardMeeting, Tuesday July 10th. Clerk Christianson will be at clerk school in Green Bay all week. There was discussion over the ordinanceprocedure on pit bulls in the Village. The Village feels that the ordinance they have in place issufficient. Christina gave a copy of ourordinance to Town of Edmund so they can come up with something similar as theyhad an occurrence with pit-bulls in their area. There has been a few complaints regarding burning and a few residentsnot being in compliance with the Village Ordinances. Clerk Christianson will issue letters to theresidents along with copies of the burning ordinances.

Library Report
Christina Christianson gave the board an update on libraryhappenings. Betty will be on vacationfrom July 16 to the 19th. This vacation time is to be paid out of the interest that the libraryreceives on their LGIP account. Christinawill transfer the money to the general account and pay from that. Summer hoursare Monday from 1pm to 6pm, Wednesday from 12:30pm to 7:30pm and Thursday from9am to Noon and 1pm to 4pm. Discussionwas had that maybe this was not enough library time and the Village shouldextend the library hours and/or have longer hours or be open more days duringthe summer. The library will be openSaturday the 23rd of June from 3:30pm to 5:15pm during the festivalso people may come in and look at the old pictures on the wall. The library will not have a float for theparade during the festival. Ron askedabout the Fair Queen information that is being worked on. Eldon Warne, Jack Slack and Roger Knutsonhave been in and working on a display for the festival.
Ric Riniker
Ric reported that there has been a zoning permit issued fora new home to be built in the Village. Aaron Sedbrook will be building on Cherwill Street. President Brown asked who checks themeasuring of lot lines and making sure it is right when all is said anddone. Ric said that it is the landowner’s responsibility to make sure it is right. Loeffelholz asked if anything was heard backon Jake Daddy’s Bar and them wanting to change the business from a bar torenting it out as an apartment. Nothingwas heard back from Tom Thompson at this time. Christina indicated that she did get back the liquor license informationfor them and they were renewing Class B Beer license at this time.
Police Report
Jones reported that there have been some reports of loudstock car engines revving after quiet time at night. He will keep an eye onthese and will talk with the land owner who has them in his yard. The residentis new in the area and may need to be made aware of noise ordinances and timesof disruptiveness. Jones stated that he will ask Iowa County for help withtraffic for the night of the fireworks during the festival as it will probablybe very busy. President Brown asked if Village of Rewey had extra barricadesthat we could use. Jones will get him anything he has available to him thatcould help us.
Citizens Concerns
Resident John Scullion was present to address the boardregarding his disapproval on the process for use of an access road where thewater tower is located. This property isacross the street from him. He isconcerned about the safety of others, and indicated that the people using theaccess road are not watching where they are going and some go to fast. He said that Tom Tonkin was not watchingwhere he was going and almost hit Don Schroeder’s grandson when they were on awalk. He did state that since a letter was sent out by Clerk Christianson acouple months ago that Denise and Bob Myers have slowed down. John also discussed with the board andwondered why his property did not have the additional Rail Road right away givenback to his parcel. He indicated that hehad talked with John Anderson at Grant County Administration offices and JohnAnderson told him he should ask the Village for a quit claim deed. JohnScullion stated that he bought the property from Gary Granville and he thoughtthe Rail Road land was to be with the house when it was sold to him. The boarddid state that some of the recordings at Grant county did not add up to what itstates address wise as we found this out when the Village started doingimprovements to Barber Street and Hwy 80. Clerk Christianson will contact John Anderson at Grant County to see whowas given a quit claim deed and who was responsible for the recording of RailRoad Property and how it was to be given back to the Village and how theVillage gave the land back to the land owners. She will talk with AttorneyInfield also to see if he has any documentation on such issues.
Secretary/Treasurers Report
Motion made by Gluege to approvetreasurer report from May 2012. Haas seconded. All in favor. Motion carried.
Motion made by Loeffelholz forClerk Christianson to transfer money between accounts for the Village. Haas seconded. All in favor. Motion carried.
Motion made by France to approvethe Delta 3 Engineering bill in the amount of $2,579.00. Water to pay 75% at $1,934.25 and General topay 25% at $644.75 for Hwy 80 and Barber St work. Loeffelholz seconded. All in favor. Motion carried.
Motion made by Richards to approvethe Owens Excavating bill in the amount of $18,382.50 out of the Water Accountfor work on Hwy 80 and Barber Street. Gluege seconded. All infavor. Motion carried.
Motion made by Loeffelholz toapprove the Esser Electric bill in the amount of $5,746.00 out of the SewerAccount for sewer lift station repairs. Haas seconded. All in favor. Motion carried.
Motion made by Haas to approve BaerInsurance bill in the amount of $5,336.00 out of the General Account forWorkman Comp and Liability Insurancecoverage. This is a semi-annualbill. Gluege seconded. All in favor. Motion carried.
Motion made by Gluege to approvethe Havlik Plumbing bill in the amount of $4,862.84 out of the General Accountfor work on the new concession building. Loeffelholz seconded. All infavor. Motion carried. Paul Havlik did not bill the Village for someof his time, which totaled $1,600.00. The Village Board acknowledges this andthanks him for his support and time. He also moved the toilets from the VillageOffice/Library down to the concession stand and put new toilets in here at theVillage Office/Library. This needs to bebilled out yet.
The bill for Ric Riniker wasreceived by Clerk Christianson tonight. This will be presented at next month’s meeting.
Liquor License/Operator LicenseApproval

All in Favor. Motion carried. Robert Becker approved with a side notestating that any one time a violation/ticket is issued against him his operatorlicense will be void.

Bart Nies-Delta 3 Engineering
Bart arrived at the meeting at 8:37pm. He informed the board of a grant that isstill available through the DNR. About 2years ago we applied for a safe drinking water program and the Village had notbeen accepted. There is now money leftover from that program, however there are 3 communities that are eligible forthe money before Livingston. We need todecide if we want to go forward with the paperwork on receiving the grant moneyfrom the Safe drinking water program through the DNR. After hearing the pros and no real cons onthe project, Richards made a motion to accept the Grant money up to$125,000.00. Gluege seconded. All in favor. Motion carried. There aredifferent ways this can be accepted and Bart will work with Clerk Christiansonand Sheila at Livingston State Bank to see what our options are and how to bestapply the money if the Village is granted the loan.
Maintenance Report
Gary stated that Chiefs Plumbingand Sludge Hauling bill has been paid. The new concession stand is up and running. The light fixture on the east side of the newconcession stand has been replaced with a yellow bulb as it was a problem witha neighbor and shining in their window. There was a sewer back up at Memorial Park. A snake line was put down the line andnothing came back up however it is not plugged anymore. The tabletop exercise was cancelled and willbe moved to next spring. The exercisesare only done in the spring of the year. Grant county will set us up when it gets closer to spring. The Iowa Grant High School had a group ofvolunteers come and help out the Village on June 7th. They did a lot of work and help out a great deal. The village would like to extend their thanksand appreciation. France made a motionto donate $200.00 to the group and/or split between the groups that were hereto help. Christina will contact EricJohannasen and find out who the donation should go to as he was the organizerof this volunteer program. Loeffelholzseconded. All in favor. Motion carried. Seal coat work in June will be pushed back tomid-end of July due to the festival. France made a motion to approve Resolution PW-2012-1 for CMAR. This is for the yearly Compliance MaintenanceAnnual Report, see attached resolution. Walter seconded. All in favor. Motion carried. Loeffelholz madea motion to issue the LCIC street closing permits without fee for Tama St andHwy 80, Fayette and E. Barber Ave and Grand to County E for festivalactivities. Richards seconded. Haas abstain. All in favor. Motioncarried. The report from Don Whitaker onGary’s truck is that it is not worth fixing. Gary should look at the cost difference between a new and used truck andlet Brown know when something comes available.
France made a motion to adjourn at 9:00 pm. Haas seconded.All in favor. Motion carried.
